Right of Way Permits

What is the Right of Way?

The Street or public way or public right-of-way means the surface of, and the space above and below a public street, road, highway, freeway, land, path, public way or place, alley, court, boulevard, parkway, drive, sidewalk, or other easement outside your property line.


Why do I need a Right-of-Way permit?

A Right-of-Way permit is required to ensure that construction meets the City's adopted standards anytime the following type of work is performed:


  • Build / repair a driveway
  • Concrete slab
  • Handicap ramps
  • Build / repair a sidewalk
  • Installation / removal of utility line
  • Build / repair parkinglot
  • Any type of work performed in the Right-of-Way area


Is there a fee for a ROW permit?

There is no fee for the permit or for the inspection. However, there is a fee for each re-inspection.


How do I obtain a ROW permit?

1. Fill out the Right-of-Way permit application

2. Submit the ROW permit application and a site layout indicating the proposed improvements (include measurements):

3. Your ROW Application is reviewed to ensure proposed improvements meet the City’s adopted standards.  Once approved, you will be notified by telephone to pick up your permit from our office.


How many days does it take for the permit to be issued?

Once applicant has submitted the required information, the permit should be issued within two business days.


Does the permit have an expiration date?

If work is not completed within 12 months from date of permit, a new permit must be obtained.

Will I need an inspection?

1) A Pre-pour Inspection is required before concrete is poured. 2) A Final Inspection is required once work is complete and area is clear of all construction material and debris.

Please note there are no inspection fees: however, a fee will apply for each re-inspection. Fees are due prior to requesting a re-inspection and may be paid at the Building Inspections Department.


Do I have to be present during the inspection?

We recommend for someone to be present, but it is not necessary. The inspector will leave an Approved or Dissaproved tag on-site.


How do I request an inspection?

You may request your inspection 24 hrs. in advance by calling the inspection request line.
