The function of the City Attorney’s Office is to serve the city with the highest quality of legal advice and representation.

The office:

  • advises the Mayor, City Commission, McAllen Public Utility Board of Trustees, City Administration, City Advisory Boards and Employees in all areas of the law;
  • handles legal issues relating to preparation/review of all documents in which the City may have an interest, ordinances, resolutions, contracts, code enforcement, zoning, legislation, real estate, labor and employment, water, franchises, tax suits, bankruptcies, civil service, law enforcement, open records, and financial matters;
  • represents the City in litigation to which it, or one of its officials in their capacity, is a party;
  • prosecutes Class “C” misdemeanors in Municipal Court, (questions involving Municipal Court call 972-7900), and
  • oversees the City’s Right of Way Department relating to acquisitions, eminent domain proceedings, and other matters.

The City Attorney’s Office has four full time attorneys, three part-time attorneys, a paralegal, legal assistant, and administrative secretary. The City Attorney’s Office cannot provide legal advice or representation to individual citizens.

Emergency Management

City Attorney, Kevin Pagan, is also the City’s Emergency Management Coordinator, by appointment of the Mayor. While the City has no formal EM Department, the Coordinator is responsible for the City’s Emergency Operations Center, emergency planning, preparedness, responses and recovery aspects of departments city-wide.
